Job Description:

KEY RESPONSIBILITIES WILL INCLUDE:

End to End contract management. Drafting, reviewing and redlining contracts and other transactional documents, and aligning same with organizational objectives.
Understanding the needs of Auto-tech, Used Car Automotive Industry, E-Commerce, and other assigned business units (“BUs”) and forming BU specific contracting standards and SOPs.
Formulation and modification of templates for general transactions in accordance with the business needs.
Converting business ideas into legal constructs most suitable for commercial needs of the organization and expanding the constructs into comprehensive contracts keeping in mind commercial and legal risks.
Quantify the risk value and be able to provide mitigating contractual language solutions to minimize the risk. Providing alternatives to break deadlocks without compromising on the risk side. Facilitate escalation of unresolved issues and requisite approvals.
Drafting and vetting of various petitions, pleadings, writs, affidavits, counter affidavits, appeals, miscellaneous applications, affidavits, civil or criminal complaints and notices.
Handling matters related to recovery and repossession of assets, obtaining interim relief u/s 9 of Arbitration and Conciliation Act. Formulation and implementation of strategies for recovery repossession of assets and ensuring resolution of such matters. Liaison with various stake holders, consumers, dealers, banks for recovery process.
Liaising with police, enforcement agencies, various government officials for resolution of cases (both at pre-litigation and post litigation stages).
Help business to proactively manage and resolve commercial disputes and manage litigations, pre-litigation, criminal matters, IBC matters, recovery matters, claims and disputes in matters relating to customers, vendors/ service providers, employees/ labour and other stakeholders filed by or against the Company and/or its officials.
Conduct training within and outside the team for briefing various stakeholders on the legal documents/contracts,litigation matters related to BUs.
Assist in reviewing business processes in the light of regulatory and legal framework related to BUs and advise & implement changes to such processes wherever required.
Ensure maintenance of contractual records and documentation, such as receipt and control of all contract correspondence, contractual changes, status reports and other documents.
Digitize legal processes and workflows.
Act as a Legal SPOC for the assigned business unit for all contractual and litigation matters.

The candidate must:

Be a law graduate i.e. LL.B. (LL.M. is a plus) from a premium Law School in India
Have 09-12 years of total post-qualification experience in the Auto-tech/E-Commerce/Information Technology/Software/Internet industry and/or law firms focusing on clients from such domain.
Demonstrate in-depth knowledge and understanding of all Commercial Laws and regulatory framework around Auto-tech/E-Commerce/Information Technology domain. In depth knowledge of Contract Act, IPR Laws, Information Technology Laws, Consumer Litigation, Civil and Criminal Litigation, Asset Reposession/Recovery, Pre-litigation dispute resolution, Arbitration, Negotiable Instruments Act, Contract Act, Sales of Goods Act, Insolvency and Bankruptcy Code.
Prior experience with Automotive Industry, Banks, NBFCs is desirable.
Be able to work independently and identify and remedy complex legal issues around contract management with minimum amount of supervision.
Have excellent and strong leadership skills with clear communication of instructions and information down the line and ability to move relevant stakeholders towards a unified direction.
Be experienced in performing legal research and writing advisories to different stakeholders.
Possess excellent documenting, recording and project management abilities.
Be used to working in a fast-paced environment for a dynamic company.
